Please read these Terms of Service and End User License Agreement ("Agreement") carefully before downloading, installing, or using the WarfighterKit mobile application (the "App"). This Agreement is a legally binding contract between you ("you" or "User") and MilMaxxing Tech LLC ("we," "us," "our," or "Company").

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, do not download, install, or use the App and promptly delete any copies in your possession.

1. No Official Military Affiliation

All references to military branches, ranks, fitness test names, uniform regulations, and military terminology are used solely for the purpose of providing a reference and utility tool to service members, veterans, military families, and other interested individuals. The use of military branch names and related terminology does not imply any official endorsement or authorization.

Any trademarks, service marks, logos, or names of military branches referenced within the App are the property of their respective owners and are used here for identification and informational purposes only under nominative fair use principles.

2. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial use, and as permitted by the Apple App Store Terms of Service (the "Usage Rules").

This license does not grant you any rights to:

• Use the App for any commercial purpose without our prior written consent.
• Distribute, sublicense, lease, lend, or otherwise make the App available to third parties.
• Access or use the App on behalf of any government entity as an officially sanctioned tool.

This license is effective until terminated by you or by us. Your rights under this license will terminate automatically if you fail to comply with any term of this Agreement.

3. Restrictions

You agree that you will not, and will not permit any third party to:

• Copy, modify, adapt, translate, or create derivative works based on the App or any portion thereof.
• Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the App.
• Remove, alter, or obscure any copyright, trademark, or other proprietary rights notice on or in the App.
• Use the App in any manner that violates any applicable federal, state, local, or international law or regulation.
• Use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App.
• Use the App to generate, store, or transmit classified, secret, or otherwise restricted military information.
• Use any output from the App (including AI-generated content) as a substitute for official military orders, directives, regulations, or guidance.
• Represent that the App is an official military tool or that its outputs constitute official military guidance.
• Use the App in any operational military environment where life, safety, or mission success depends on the accuracy of the information provided.

4. Accuracy of Information

4.1 General Reference Information

The App provides reference information related to military fitness tests, uniforms, pay calculations, land navigation, study guides, and other military-related topics. While we make reasonable efforts to ensure the accuracy and currency of this information, we do not warrant or guarantee that any information provided by the App is accurate, complete, reliable, current, or error-free.

Military standards, regulations, pay tables, uniform requirements, and other official information are subject to change at any time by the relevant military authorities. The App may not immediately reflect such changes. You are solely responsible for verifying any information obtained through the App against current, official military sources.

4.2 Fitness Test Scoring

Fitness test scores displayed within the App are calculated based on publicly available, published scoring standards for military physical fitness assessments. However:

• Scores are provided for informational and training purposes only.
• Calculated scores may differ from official scores due to rounding differences, scoring table version discrepancies, or implementation variations.
• Scores generated by the App do not constitute official test results and cannot be used as a substitute for officially administered and recorded fitness assessments.
• You should always verify scores with your unit's official fitness test administrator or the applicable official scoring resources.

4.3 Land Navigation Tools

The App includes land navigation features such as Military Grid Reference System (MGRS) coordinate display, compass functionality, and waypoint management. These tools are provided strictly for training and reference purposes.

• Navigation tools rely on your device's built-in GPS and compass sensors, which are subject to hardware limitations, environmental interference, and inherent inaccuracies.
• The App is NOT designed, intended, or suitable for use in combat operations, tactical movements, real-world military missions, or any situation where navigation errors could result in injury, death, or mission failure.
• GPS signals may be degraded, unavailable, or unreliable in many environments, including dense vegetation, urban canyons, underground locations, and areas with electronic interference.
• You must never rely solely on the App for navigation in any situation involving personal safety.

4.4 Planning Document Templates

The App provides templates for military planning documents, including Situation Reports (SITREPs), Operations Orders (OPORDs), UXO (Unexploded Ordnance) Reports, and Evaluation Bullet statements. These templates are provided for training and educational purposes only.

• Templates are based on general military doctrine and may not conform to the specific formatting requirements of your branch, unit, or command.
• Documents created within the App do not constitute official military orders, reports, or communications.
• UXO Reports generated by the App are for training and record-keeping purposes only and do not replace official Explosive Ordnance Disposal (EOD) reporting channels.
• Evaluation Bullet statements are provided as drafting aids and must be reviewed and approved through your chain of command before use in official evaluations.
• Do not use the App to create, store, or transmit documents containing classified, sensitive, or operationally restricted information.

4.5 Pay Calculator

The pay calculator feature provides estimates based on publicly available military pay tables and allowance rates. These estimates are for informational purposes only and may not account for all factors affecting your actual compensation, including special pays, deductions, tax withholdings, or individual entitlements. Always consult your finance office or official pay resources (such as the Defense Finance and Accounting Service) for authoritative pay information.

4.6 Study Guides and Recruit Tools

Study materials, reference guides, and recruit-focused tools (including ASVAB study resources within the WF Recruit section) are compiled from publicly available sources. They are intended to supplement, not replace, official military training materials, courses of instruction, and doctrinal publications. We do not guarantee that study guide content is current or complete. ASVAB practice content is for preparation purposes only and does not replicate actual ASVAB test questions.

4.7 Physical Stats Dashboard

The Physical Stats dashboard aggregates your locally stored fitness data (activity records, PT test scores, distance, calories) into charts and summary widgets. These visualizations are for personal tracking and motivation purposes only. Calculated metrics such as weekly totals, personal bests, and trend data are derived from user-entered information and may not precisely match officially recorded results.

4.8 Common Operating Picture (COP) Dashboard

The main screen COP widget displays a date-time group, mini map with your current location, and fitness summary data. The COP is a personal reference dashboard and does not represent any official military common operating picture. Map data is provided by Apple Maps and is subject to Apple's terms of service and data accuracy limitations.

5. AI Assistant Feature

The App includes an optional AI assistant feature powered by third-party artificial intelligence services. If you choose to enable and use this feature, you acknowledge and agree to the following:

• No Guarantee of Accuracy: The AI assistant may generate responses that are inaccurate, incomplete, outdated, misleading, or entirely fabricated ("hallucinations"). AI-generated content should never be treated as authoritative or relied upon without independent verification.
• Not a Substitute for Professional Advice: The AI assistant does not provide official military guidance, legal advice, medical advice, financial advice, or any other form of professional counsel.
• User Responsibility: You are solely responsible for evaluating the accuracy and usefulness of any AI-generated content. Any actions you take based on AI-generated responses are entirely at your own risk.
• Third-Party Service: The AI feature requires you to provide your own API key. Your use of the underlying AI service is subject to the terms and conditions of the third-party provider. We are not responsible for the availability, performance, or conduct of the third-party AI service.
• No Military Expertise: The AI assistant is a general-purpose language model. It is not specifically trained on or verified against current military regulations, doctrine, or standards.

6. Third-Party Services

6.1 Apple App Store

You acknowledge that this Agreement is between you and MilMaxxing Tech LLC, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. Your use of the App must comply with the App Store Terms of Service. Apple has no obligation to provide maintenance or support services for the App.

6.2 Anthropic API

If you choose to use the optional AI assistant feature, your interactions with the Anthropic API are governed by Anthropic's own API Terms of Service and Privacy Policy. We are not responsible for any data you transmit to Anthropic or for Anthropic's handling of that data.

6.3 External Links and Resources

The App may contain links to external websites, government resources, PDFs, and other third-party content. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites or services. You access external resources at your own risk.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. Key points include:

• The App does not require user accounts, login, or registration.
• All data you enter into the App is stored locally on your device.
• We do not operate servers or cloud infrastructure for this App.
• We do not collect, transmit, or have access to your personal data, except for data you voluntarily send to the Anthropic API through the optional AI assistant feature.
• If you delete the App, all locally stored data is permanently removed.

8. Intellectual Property

The App, including its design, code, graphics, user interface, and all other elements (excluding third-party content and military-specific terminology), is the property of MilMaxxing Tech LLC and is protected by copyright, trademark, and other intellectual property laws of the United States and applicable international treaties.

This Agreement does not grant you any ownership interest in the App. All rights not expressly granted herein are reserved by MilMaxxing Tech LLC.

9. Disclaimers

To the fullest extent permitted by applicable law, MilMaxxing Tech LLC expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
• Warranties regarding accuracy — We do not warrant that any information, scores, calculations, coordinates, templates, pay estimates, or other content provided by the App is accurate, complete, current, or reliable.
• Warranties regarding availability — We do not warrant that the App will be uninterrupted, timely, secure, or error-free.
• Warranties regarding fitness for military use — We expressly disclaim any warranty that the App is suitable for use in official military operations, combat, tactical decision-making, or any situation where errors could result in harm to persons or property.
• Warranties regarding device compatibility — We do not warrant that the App will function correctly on all devices, operating system versions, or hardware configurations.

You acknowledge and agree that your use of the App is at your sole risk. No advice or information, whether oral or written, obtained by you from us or through the App shall create any warranty not expressly stated in this Agreement.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MILMAXXING TECH LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY OF THE FOLLOWING ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP:

• Any indirect, incidental, special, consequential, punitive, or exemplary damages, regardless of the theory of liability.
• Any loss of profits, revenue, data, goodwill, or other intangible losses.
• Any personal injury, bodily harm, or property damage resulting from reliance on information provided by the App, including but not limited to navigation data, fitness test scores, or AI-generated content.
• Any damages resulting from errors, inaccuracies, or omissions in the App's content, including pay calculations, fitness scoring, uniform references, or study materials.
• Any damages arising from unauthorized access to or alteration of data stored on your device.
• Any damages arising from the conduct or content of any third-party service accessed through the App.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF THE APP EXCEED THE AMOUNT YOU ACTUALLY PAID TO US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY U.S. DOLLARS ($50.00), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless MilMaxxing Tech LLC and its officers, directors, members, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of or access to the App.
• Your violation of this Agreement.
• Your violation of any applicable law or regulation.
• Your reliance on any information provided by the App for any purpose.
• Any claim that your use of the App caused harm to a third party.

12. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms.

We reserve the right to terminate or suspend your access to the App at any time, for any reason, without prior notice or liability. We may also cease providing the App or any updates at any time without notice.

Upon termination of this Agreement, you must cease all use of the App and delete all copies from your devices. The following sections shall survive termination: Sections 1, 3, 4, 5, 8, 9, 10, 11, 13, 14, and 15.

13. Governing Law and Dispute Resolution

13.1 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Hawaii, United States of America, without regard to its conflict of law provisions.

13.2 Jurisdiction and Venue

Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in Honolulu, Hawaii. You consent to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts.

13.3 Informal Dispute Resolution

Before initiating any formal legal proceeding, you agree to first contact us at the email address provided below and attempt to resolve the dispute informally for a period of at least thirty (30) days. Most concerns can be resolved this way.

14. General Provisions

14.1 Entire Agreement

This Agreement, together with the Privacy Policy and the Apple App Store Terms of Service, constitutes the entire agreement between you and MilMaxxing Tech LLC regarding the App and supersedes all prior or contemporaneous agreements, understandings, and communications, whether oral or written.

14.2 Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, it shall be severed from this Agreement. The remaining provisions shall continue in full force and effect.

14.3 Waiver

The failure of MilMaxxing Tech LLC to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if in writing and signed by MilMaxxing Tech LLC.

14.4 Assignment

You may not assign or transfer this Agreement or any rights or obligations hereunder without our prior written consent. We may assign this Agreement without restriction. Subject to the foregoing, this Agreement shall bind and inure to the benefit of the parties and their permitted successors and assigns.

14.5 No Third-Party Beneficiaries

This Agreement does not create any third-party beneficiary rights, except that Apple Inc. and its subsidiaries are third-party beneficiaries of this Agreement solely with respect to your compliance with the App Store Terms of Service, and Apple shall have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

14.6 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under this Agreement where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, government actions, or failures of internet or telecommunications infrastructure.

15. Changes to This Agreement

We reserve the right to modify or replace this Agreement at any time at our sole discretion. When we make material changes:

• The "Last Updated" date at the top of this Agreement will be revised.
• We will make reasonable efforts to notify you of material changes through the App or its App Store listing.
• Your continued use of the App after any changes to this Agreement constitutes your acceptance of the revised terms.

If you do not agree with any modifications, your sole remedy is to discontinue use of the App and delete it from your devices.

16. Apple-Specific Terms

The following terms apply to your use of the App as downloaded from the Apple App Store:

• This Agreement is between you and MilMaxxing Tech LLC only, and not with Apple. MilMaxxing Tech LLC is solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your use of the App, including: (a) product liability claims, (b) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (c) claims arising under consumer protection or similar legislation.
• In the event of any third-party claim that the App or your use of the App infringes that third party's intellectual property rights, MilMaxxing Tech LLC, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo or has been designated as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
